Evgenia Zusman spoke at the Interdepartmental Conference “Financing the Health System” (Finzdrav 2018)

On 18 December 2018, the Partner of You & Partners, Evgenia Zusman, made a presentation on “Experience in implementing PPP projects and concession projects in the field of medicine. Problems and directions of changes in PPP and concession legislation” within the framework of the breakout session 4 of the Interdepartmental Conference “Financing the Health System” (Finzdrav 2018).

In her speech, Evgenia spotlighted the current status of legislation and practice regarding public-private partnerships and concession agreements in the field of health care. Evgenia made a point that health care sector is the leader in implementing the projects in the form of a concession in the social sphere, with the mechanism of a private concession initiative, the PCI, being just as popular. In addition, the healthcare sector is one of a handful sectors of the economy, in which not concession agreements alone are implemented, but also PPP / MPP agreements under 224-FZ.

Evgenia made special mention that in 2018 an important amendment was adopted with regard to healthcare facilities, enabling the federal state budget institutions (FGBUZ) to participate on the side of the concession grantor regarding healthcare facilities.

In conclusion, Evgenia mentioned risks arising from implementation of concession agreements and agreements on PPP / MPP, such as complicacy of concluding agreements on reconstruction of selected premises (rather than the entire real estate unit) or lack of an investment component in the Compulsory Medical Insurance tariffs.

The Conference was also attended by representatives of the Federation Council and the State Duma of the Russian Federation, RF Ministry of Health, RF Ministry of Finance, Federal Service for Supervision in the Field of Healthcare of the Federal Fund for Compulsory Medical Insurance, and business community.
