Evgenia Zusman comments on Ministry of Finance's standard form proposal, seen as a threat to the PPP market
02.10.2025Access to subsidies for Public-Private Partnerships (PPPs) and concessions may be granted only if agreements are concluded via the «Electronic Budget» system using a standard form. The corresponding draft law No. 1026189-8 has been submitted to the State Duma.
The Ministry of Finance is not only proposing mandatory standard agreement forms but is also making their use a condition for receiving subsidies. This decision, made without public discussion with the industry, is raising significant concerns among all PPP market participants.
As commented by Evgenia Zusman, Managing Partner of You & Partners: »The diversity in the subject matter and objects of PPP agreements stems from the complex nature of modern infrastructure projects. Attempts at standardization run counter to the fundamental complexity and uniqueness of each concession project, making the application of universal templates unworkable».
This initiative appears detrimental to a market that, amidst high key rates, is actively initiating agreements and attracting debt financing. If a single, rigid form is imposed, the number of market-driven concession projects will likely decrease.
