You & Partners expert discussed the nuances of the PPP private initiative mechanism "application for readiness to participate in PPP projects"
01.11.2021On October 28th ROSINFRA, a platform for supporting infrastructure projects, published an expert opinion on certain peculiarities of regulating the application for readiness to participate in the tender for determining the concessionaire on the terms proposed under the private concession initiative.
In the published opinion You & Partners associate – Victoria Tugolukova analyzed the legal requirements to the procedure of alternative application compared to the requirements that are applied to the proposals of the originalinitiators.
Further analysis was devoted to the three approaches of the Russian judicial practice on the issue of supporting documentation for submitting alternative applications.
On the basis of the analyzed case law, decisions of the antitrust authorities and legal provisions the risks of each of the three scenarios were assessed.
