You & Partners Managing Partner Evgenia Zusman Comments on Draft Rules for Concession Agreement Assessment
06.02.2026A draft government resolution introducing mandatory socio‑economic efficiency assessments for concession agreements has been published on the official portal for draft regulatory legal acts (regulation.gov.ru). Public consultation on the document will run until February 19, 2025.
The new procedure, developed by the Ministry of Economic Development, significantly changes the way concessions involving state participation are launched. Previously, such an assessment was only required for public‑private partnership (PPP) agreements; now it will become a mandatory step for all concessions that involve financing from the concedent (state or municipal authorities).
Efficiency criteria:
For a project to be approved, it must meet three key parameters:
-
Align with the goals and objectives of state programmes (federal, regional, or municipal).
-
The technical and economic indicators of the facility must improve at least two target indicators of those programmes.
-
The justification for creating the facility and the need for the services to be provided there must be confirmed.
The total assessment period may take no less than 120 days.
Evgenia Zusman, Managing Partner of You & Partners, views the push for stronger oversight of concession agreements positively. However, she notes that the new procedure is more protracted and multi‑layered compared to PPP projects.
“It is important that VEB.RF and the authorised bodies provide methodological support to applicants. In addition, it would make sense to set a minimum threshold of financial participation by the concedent, above which this assessment becomes mandatory. That would reduce the administrative burden on businesses,” she emphasised.
